James Parton III
Attorney James Parton has been awarded the prestigious Super Lawyers® designation for 14 consecutive years and has been AV Preeminent® rated for over 30 years. He believes the key to helping every client is figuring out what a “successful” outcome for their problem or litigation will be, given the realities of the facts and the law. More than their attorney, he becomes his client’s confidant, supporter and coach.
Jim has 40 years of experience in trial and appellate litigation, specializing in employment law, products liability, real property law and consumer rights litigation. As an employment law attorney, he has successfully defended businesses of all sizes, as well as individual managers, against all kinds of employment claims. His experience includes defending management in federal and state court lawsuits involving claims of race, sex, age, sexual-orientation, national origin and disability discrimination; sexual, harassment; wrongful termination; retaliation; workplace violence; invasion of privacy; wage & hour violations; unfair business practices; and trade secrets violations. He has defended individual claims, multiple plaintiff sexual harassment claims and wage and hour class actions involving classification, meal and rest periods and other pay-related issues.
Jim’s experience also includes representing his clients in a variety of administrative proceedings, including Labor Code §132a retaliation claims before the Workers Compensation Appeal Board, proceedings before the California Labor Commissioner, and investigations by, and administrative proceedings before, the Department of Fair Employment and Housing, the Equal Employment Opportunity Commission, the Department of Labor Standards Enforcement and the Department of Labor.
Jim has retired from litigation practice but continues advising local businesses on compliance issues involving employee and HR issues. He applies his extensive knowledge of litigation to help those clients avoid expensive lawsuits and administrative hearings and to position themselves for a more effective defense should that be unavoidable. His experience includes: preparation of employment contracts and severance agreements; supervising and directing investigation of claims regarding sexual, racial, disability and other harassment and discrimination; advising management regarding compliance with federal, state and local affirmative action requirements; directing the interactive process response to claims of disability and requests for reasonable accommodation; and guiding management through tricky employee discipline and termination issues.
In addition to his broad experience as an employment law attorney, Jim has devoted his career to the defense of product liability and catastrophic personal injury and wrongful death litigation. He has applied this deep legal experience defending Honda in complex motor vehicle product liability and warranty litigation for over 30 years. He has represented a wide range of manufacturers involving vehicular, recreational, consumer and home products.
Jim is married to Maureen Brown Parton, who is also an attorney. They have a daughter, Jane, and a son, Nate. Jim also has two adopted sons from his first marriage, Phillip and Christopher. Jim devotes his free time to organic gardening, nature photography and hiking.
Every morning you’ll find Jim and Maureen walking up and down the Mill Valley Dipsea Stairs (all 688 steps!). This keeps them both young and in shape for their annual hikes in the Sierra and Cascade mountain ranges. Jim also takes advantage of the bounty of small live music venues in the San Francisco Bay Area. His taste is eclectic and includes jazz (sparked by Nate’s experience playing jazz guitar with the Berkeley Jazz School Studio Band), blue grass, West African and world music and good old rock ‘n’ roll.
